Abstract

In this world of competition, the protection of intellectual capital of a business through patent, copyright and trademark is the need of the hour. Similarly, there is also a legal provision provides protection against misuse of confidential information of a business concern through maintaining trade secrets. At present there is no specific and comprehensive legislation to regulate the protection of trade secrets and confidential information in India, but the courts have given guidelines through their verdicts by way of various landmark case laws. That means in absence of specific law, the parties must rely on the terms of the contracts for the protection of their trade secrets and confidential information. The present paper is an attempt to highlight various provisions in the Indian legislations and deduce the suitable guidelines to protect trade secrets and confidential information of a business unit.
