Investor confidence is being shaken by the weak balance sheets of public sector banks, which the banks need to confront head-on. The term “bad bank” was first used in the 1980s in the United States, and many other nations soon followed suit to rid their balance sheets of these hazardous assets. The bad banks guarantee the banks that they will take on these non-performing assets (NPAs) at a discount to book value and subsequently recoup them. The suggestion to form a bad bank to transfer the distressed assets was also proposed by the Indian Banking Association. This essay tries to comprehend the idea of a “bad bank,” how they have developed, what their structure is, how they are implemented, and how they affect the economy. The report provides insight into the regulatory framework currently in place in the Indian banking sector to safeguard depositors’ and investors’ interests. The study also focuses on how this paradigm functions, as well as its advantages and challenges in the Indian setting.
2024-11-25T00:00:00+00:00Copyright (c) 2024 NOLEGEIN-Journal of Corporate & Business Laws
