An Analysis of the Relationships Between Competition and Intellectual Property Laws in the Situation in India
Abstract
India is a country of systematic legal framework whether it is for individuals or for corporates. Ever since constitution was adopted there has been periodic up gradation and amendments in laws so that it suits best to the current environment, in this light in the present study we are attempting to compare the Indian competition act and Intellectual property laws. This study examines the intricate relationship between the Indian Competition Act and the country's intellectual property laws, shedding light on the potential conflicts and complementarities that arise from their intersection. Through a comprehensive analysis of relevant statutes, judicial precedents, and scholarly discourse, the study explores the delicate balance required to promote fair competition while safeguarding intellectual property rights. It highlights the challenges faced by policymakers and regulatory authorities in addressing anti-competitive practices involving intellectual property, while ensuring that incentives for innovation and technological advancement are not compromised. Furthermore, the research delves into potential harmonization strategies and offers recommendations for effective enforcement and better alignment between these two critical legal domains, aiming to foster an environment that encourages both competition and innovation, driving economic growth and fostering a thriving knowledge-based economy.
