Legal Aspects of Cannabis Cultivation

Abstract

Growing from the Cannabis sativa or Cannabis indica plant, marijuana is a commonly used narcotic   with both beneficial and negative effects on the body and mind. Despite being prohibited in India under the NDPS Act of 1985, some states are considering legalizing it Cultivation of marijuana requires specific conditions and can be done outdoors or indoors. While many countries have legalized marijuana, the UAE strictly prohibits it while Canada has legalized it for both medical and recreational purposes. The legal aspects of marijuana cultivation are governed by global laws such as the Single Convention for Narcotic Drugs of 1961 and the NDPS Act of 1985 in India. Recent developments show discussions on legalizing cannabis cultivation for industrial and medicinal purposes in Himachal Pradesh. Canada and the UAE have contrasting views on marijuana, with Canada legalizing it and the UAE imposing strict penalties for its use. The recent UN decision to reclassify cannabis is significant, indicating a shift towards recognizing its medicinal potential. India's NDPS Act criminalizes cannabis use, but the country has supported the UN's decision to reclassify it. It suggests a need to review the current laws on cannabis in India to align with international standards and consider the benefits of legalization with strict regulations to prevent misuse
